Wills

A Will is the only way to be sure your estate goes to the people you choose.

Your Will says who receives your assets and appoints an executor to carry out your wishes. Without a valid Will, your estate is divided according to a formula set by law, which may not be what you would have wanted.

A professionally prepared Will can

  • Name the people and charities you want to benefit

  • Appoint an executor you trust

  • Nominate a guardian for children under 18

  • Set up testamentary trusts for tax and asset protection

  • Record your funeral wishes

  • Reduce the risk of a claim against your estate

When to review your Will

Review your Will whenever your life changes: marriage, separation or divorce, a new partner, a new child or grandchild, the death of a beneficiary or executor, or buying or selling major assets. Marriage and divorce can change how an existing Will works.

On 1 January 2025, the Succession Act 2023 (SA) replaced South Australia's old laws on Wills. Existing valid Wills still stand, but it's a good time to check that yours still reflects your wishes.
