Drink & Drug Driving

A positive test doesn't automatically mean you're guilty.

Sandstone court building in Adelaide, South Australia

Drink and drug driving charges carry licence disqualification, fines and, for repeat or serious offences, possible imprisonment. In some cases, police can take your licence on the spot and impound your vehicle.

Police must follow strict procedures when they test you, take samples and record results. If those steps aren't followed properly, the case against you may be weakened or withdrawn.

What we check

  • Whether the breath or drug test was done within the time allowed

  • The timing between breath samples

  • Whether you were told about your right to a blood test

  • Whether the reading accurately reflects your alcohol level at the time you were driving

Charges we defend include

  • Drink driving (prescribed concentration of alcohol)

  • Driving under the influence

  • Drug driving

  • Refusing or failing to comply with a breath or drug test

  • Immediate loss of licence notices
